These Terms & Conditions (“Terms”) apply to all sales, deliveries, plant installations, warranties, and services provided by JMD Trees (“we,” “us,” or “our”). By placing an order, scheduling delivery or installation, or accepting plant material from us, you agree to be bound by these Terms.
1. Orders & Pricing
All prices quoted or displayed are for plant material only unless otherwise stated. Delivery, installation, and applicable taxes are additional charges unless included in a written quote.
Prices are subject to change without notice. Availability of specific tree sizes or varieties is not guaranteed until confirmed.
2. Payment Terms
Payment in full is required prior to delivery or installation unless otherwise agreed to in writing. Wholesale pricing is available for approved contractors, landscapers, builders, and HOAs.
Failure to complete payment may result in order cancellation.
3. Delivery & Installation
Delivery will be made to the address provided by the customer. It is the customer’s responsibility to ensure clear and safe access for delivery vehicles and equipment.
- Clear access for trucks and equipment
- No underground utilities, irrigation lines, or obstructions in planting areas
Additional fees may apply for difficult access, delays, or rescheduling.
Installation services, when provided, include planting only. We are not responsible for underground utilities, drainage issues, or soil conditions beyond normal planting practices.
4. Cancellations & Changes
Order changes or cancellations must be made at least 72 hours prior to scheduled delivery or installation.
Cancellations made after this period may be subject to restocking fees, delivery fees, or labor charges. Custom or specially sourced plant material may not be eligible for cancellation.
5. Warranty Policy (6-months Limited Warranty)
JMD Trees provides a six (6) month limited replacement warranty on most trees planted by our team, beginning on the date of installation.
If a tree dies due to defective plant material, we will replace the tree one time only.
This warranty does NOT cover:
- Improper watering or lack of care
- Extreme weather (freeze, drought, heat stress, flooding, storms)
- Vandalism, animal damage, or mechanical damage
- Soil or drainage conditions
- Trees planted in containers
- Trees planted by others
- Replacement trees
- Relocated or transplanted trees
No cash refunds will be issued. If an identical replacement is not available, a store credit may be issued at our discretion.
The warranty is non-transferable and applies only to the original purchaser.
6. Customer Care & Maintenance Responsibility
Proper aftercare is essential to tree survival. The customer is responsible for:
- Regular watering
- Monitoring soil moisture
- General care and maintenance
Failure to properly care for trees may void any warranty.
7. Risk of Loss
Once delivery or installation is completed, all risk of loss transfers to the customer.
8. Limitation of Liability
JMD Trees’ liability is strictly limited to the replacement cost of the plant material as outlined in this policy.
We are not responsible for incidental, indirect, or consequential damages, including but not limited to property damage, loss of use, or landscaping costs.
9. Wholesale & Contractor Sales
Wholesale sales are subject to separate pricing and terms. Warranty coverage for wholesale purchases may differ and must be confirmed prior to purchase.
10. Changes to These Terms
We reserve the right to update or modify these Terms at any time without prior notice. The most current version will always be available on our website.
